Terms of Service

1. Agreement to Terms

By accessing or using SysWP ("Service"), operated by SYSWP ("Company", "we", "us"), you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not access the Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

SysWP is a web performance monitoring platform that provides:

• Website performance analysis using Google PageSpeed Insights API (lab data for mobile and desktop)
• Real User Monitoring (RUM) through a JavaScript snippet installed on your website
• Uptime monitoring with incident tracking and alerts
• Sitemap health checking (broken link detection)
• HTTP security headers auditing
• Live traffic visualization with visitor classification
• Bot and AI crawler detection (Googlebot, GPTBot, ClaudeBot, etc.)
• Geolocation-based traffic analytics
• WordPress plugin for server-side data collection and database optimization
• Automated email and WhatsApp performance alerts
• Shareable public performance reports

3. Accounts

When you create an account, you must provide accurate, complete, and current information. You are responsible for safeguarding your password and for any activities or actions under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use as a username the name of another person or entity that is not lawfully available for use, or a name or trademark that is subject to any rights of another person or entity without appropriate authorization.

4. Free Trial

SysWP offers a 5-day free trial for new users. During the trial period, you have access to limited features: 1 domain with up to 5 monitored URLs. At the end of the trial, your account will be restricted unless you subscribe to a paid plan. No credit card is required for the trial. Trial data may be retained for up to 30 days after expiration.

5. Subscriptions and Payments

Paid plans are billed monthly through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You can cancel your subscription at any time through your account settings or the Stripe Customer Portal. Upon cancellation, you retain access until the end of the current billing period. Refunds are handled on a case-by-case basis at our discretion.

6. Monitoring Snippet and WordPress Plugin

To collect Real User Monitoring data, you must install our JavaScript snippet or WordPress plugin on websites you own or have authorization to monitor. By installing the snippet or plugin, you confirm that:

• You own or have legal authority to monitor the website
• You will inform your website visitors about data collection in your own privacy policy
• The collected data (performance metrics, device info, geographic location) will be transmitted to and stored by SysWP
• The WordPress plugin may access server-side information including PHP version, database metrics, installed plugins, and theme information for optimization recommendations
• Database optimization features are opt-in and require explicit authorization

7. Acceptable Use

You agree not to:

• Use the Service to monitor websites you do not own or have authorization to monitor
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Use the Service to conduct DDoS attacks, load testing, or other abusive activities
• Resell or redistribute the Service without our written consent
• Exceed the limits of your subscription plan through automated means
• Use the Service to collect personal data in violation of applicable laws
• Interfere with or disrupt the integrity or performance of the Service

8. Data Ownership

You retain all rights to the performance data collected from your websites. We do not sell, share, or use your monitoring data for any purpose other than providing the Service to you. Aggregated, anonymized data may be used to improve the Service. Upon account deletion, your data will be permanently removed within 30 days.

9. Public Reports

When you generate a shareable public report, the report data becomes accessible via a unique URL to anyone who has that link. You are responsible for controlling who receives the report link. Public reports may include a promotional link to SysWP. You can revoke access to any public report at any time through your dashboard.

10. Service Availability

We strive to maintain 99.9% uptime for the Service. However, we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. We will provide reasonable notice for planned maintenance when possible. We are not liable for any damages resulting from service interruptions.

11. Third-Party Services

SysWP integrates with third-party services including Google PageSpeed Insights API, Stripe for payment processing, and ip-api.com for geolocation. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability or accuracy of third-party services.

12. WordPress Plugin & Remote Access

The SysWP WordPress Plugin provides additional monitoring capabilities including server-side data collection, database health analysis, remote plugin updates, and one-click admin access. By installing and activating the plugin, you authorize SysWP to: (a) collect server environment data (PHP version, database metrics, plugin/theme inventory); (b) perform database optimization operations when explicitly enabled by you; (c) execute plugin updates on your behalf with automatic backup and rollback; (d) generate temporary authentication tokens for remote admin access. All communications between the plugin and SysWP are signed with HMAC-SHA256. Remote database optimizations require explicit opt-in through the plugin settings. SysWP is not liable for any issues arising from plugin updates or database operations, although we implement automatic rollback mechanisms to minimize risk.

13. Limitation of Liability

In no event shall SYSWP, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service. Our total liability for all claims related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

13. Termination

We may terminate or suspend your account immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties, or for any other reason at our sole discretion. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, specifically the Marco Civil da Internet (Law No. 12.965/2014) and the Brazilian General Data Protection Law (LGPD - Law No. 13.709/2018), without regard to conflict of law provisions.

15. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Material changes will be notified via email or through the Service at least 30 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
